By using or visiting our website: www.TBubble.com; that is, collectively, all of its content and functions which are made available through TBubble, you are agreeing to the terms and conditions, and at the same time, you are indicating that you have read, understand and agree to be bound by these Terms of Use; in short, this Agreement, regardless to the fact that you are a registered member or not. Although we may take the initiative to notify you of any major changes, which are made within our Terms of Service, it is up to you to review the Terms of Use within a period of time. At our sole discretion, TBubble reserves the right to change, modify, or revise these Terms of Use and policies at any time without notice; in addition, you agree to be bound by any changes that we make to these Terms of Use. Perhaps you do not agree to some of our terms, for that matter, if that is the case, please refrain from using the www.TBubble.com website; that is, do not use the website if you do not agree to its Terms of Use.

Basic Terms

The TBubble Website is intended for users who are thirteen (13) years of age or older; however, people who are under the age of 13 may use the website, but require the permission of their legal guardian. By using the service provided by TBubble, you affirm that you are of the ages listed above or have the permission of your legal guardian. Furthermore, you are also acknowledging that you agree to all of the Terms, Use, and Conditions of the TBubble website.

My Bubbler Account

Please take notice that you are agreeing, per the use of our site, to provide accurate information when creating your account; that is, up-to-date and complete information about yourself as the sign up data may require. For your own security, the password and identification to your account must be kept private in order to avoid any intrusion into your account. You are responsible for any activity, which occurs, in your account. If you believe that someone else has used your account, please notify TBubble immediately. We, at TBubble, will not be responsible for any losses you may incur due to an unauthorized use of your account; however, you may be responsible for any losses that we may incur due to the unauthorized use of your account.

TBubble’s Property and the User's Rights to its Content

The content that is made available through the TBubble Website and Service are the proprietary property of TBubble. This includes but is not limited to the designs, text, graphics, videos, music, pictures, software, and written details. In addition, the materials on the site are the property of TBubble, the entity, and its users with all rights reserved.

The contents on the site may not be altered, distributed, reproduced, or represented in any other form without the prior consent of TBubble, which may be obtained by contacting TBubble; however, this does not include the content which the user uploads on the website; in regards to the users own content, one must have permission from the specified user if they wish to reproduce, alter, modify, or represent it in any other manner. As a user, you have all of the rights to your own property, given that the content is indeed your own property, which allows you to have the right to include this content on whichever website that may please your liking, but this is only in regard to your own user material; not the material of others.

In addition, you warrant and agree that the materials submitted or shared by you while using your account on TBubble is indeed yours, and if it is not, you have been given the right to use and share the material; furthermore, you are confirming that the material does not violate the rights of any third party, including but not limited to copyrights, privacy, trademarks, or personal rights to any other individual, which is unlawful. If we receive notification that materials posted by you, the user, is infringing on anyone’s rights, we will promptly remove the material from our site. Please be aware that any use of the Site or the Content within the Site in a manner that is not in the limits of the guidelines specified within our Terms of Use and Conditions is not authorized by anyone, unless the authorization has been given to you by TBubble LLC; such use is strictly prohibited and will be enforced, and if broken, will be the result of an immediate termination of the given user’s account without warning, and in some cases, subject to highest penalties allowed by the law.

Logo and Name

The name TBubble is a trademark of the Company and may not be used in any manner unless you have been given written permission prior to its use. The name cannot be used in a manner where another name sounds the same or represents itself in the same function and manner that TBubble regards itself. In addition, the name may not be used in any manner or function, which may lead to confusion from an outside perspective due to the fact that it appears to have been imitated, copied, or used in a manner that is detrimental to TBubble. By itself, the logo is a clear representation of TBubble. The logo cannot be used in any manner whatsoever without the authorization of TBubble. The logo, by itself, is a representation of TBubble and cannot be used by any other entity, items, or public displays, without the authorization of TBubble.

Code of Conduct

TBubble is a friendly website which does not want any of its members to feel offended in any manner. Perhaps there will be moments where you are in conflict with other members; please note that is your responsibility to maintain a level maturity, which does not jeopardize the safety of any other member. TBubble is not a platform made for you to settle your differences with others. In addition, it is your responsibility to be up-to-date with the laws and regulations of your city, state, and country.

As a member of TBubble, you claim responsibility for all of your text, messages, photos, videos, information, and images that are associated to your profile and account. If you have not been given the permission to post any material, which is not your own, then you do not have the right to include it as part of your account on TBubble. Pornographic materials are not allowed on the TBubble website, and will not be permitted in any manner. TBubble’s community includes minors, which ultimately means that any material submitted by a user that we feel may suggest relations to pornographic content will be deleted and the user will have his/her account deleted immediately. TBubble fully reserves the right at its own discretion as to what is, or might be, offensive, illegal or is offending other members. TBubble is not responsible for any content that you as a user might lose on our website. It is your responsibility to maintain a backup of all your materials. Please be aware that once you delete your account, all of your materials will be deleted soon thereafter, as you confirm your request to have your account deleted.

Third Party Websites

TBubble may contain certain links that may lead to third party websites that are not owned or controlled by TBubble; that is, links that leads to articles, images, music, videos, information, other companies, and other materials, which are derived from third party sources. TBubble cannot assume responsibility for such material because we do not control the material generated from other websites, and therefore, can assume no responsibility for third party actions. For safety measures, please note the sites that you are entering and take all the necessary precautions: you are ultimately responsible for all activity that takes place on a third party website regardless of how, or through what, you access the said website.

Disputes; Governing Laws

By visiting or using the Site and/or the Service, you agree that the laws of the State of Delaware, without regard to principles of conflict of laws, will govern these Terms of Use and any dispute of any sort that might arise between you and the Company or any of our affiliates. You agree that any dispute arising from this Agreement shall not be litigated in any other state, with the exception of the state and federal courts of Massachusetts, and you hereby consent to, and waive all defenses in regards to the jurisdiction and non-convenience with respect to, location and jurisdiction in the state and federal courts of Massachusetts.

Limitation of Liabilities

UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, WHETHER TORT (INCLUDING NEGLIGENCE), CONTRACT, OR OTHERWISE, SHALL TBUBBLE LLC BE LIABLE TO ANY PERSON FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR ANY AND ALL OTHER COMMERCIAL DAMAGES OR LOSSES, EVEN IF SUCH PARTY SHALL HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES. THIS LIMITATION OF LIABILITY SHALL NOT APPLY TO LIABILITY FOR DEATH OR PERSONAL INJURY RESULTING FROM SUCH PARTY'S NEGLIGENCE TO THE EXTENT APPLICABLE LAW PROHIBITS SUCH LIMITATION. Suggestion

You acknowledge and agree that any suggestions, questions, comments, ideas, feedback or other information about the Site or the Service, provided by you to TBubble are non-confidential and shall become the sole property of TBubble. TBubble shall own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use and dissemination of these Suggestions for any purpose, commercial or otherwise, without acknowledgment or compensation to you.

Indemnity

• Creating Your Account

  
  
  TBubble is a new entertainment website for Musicians, Models, Dancers, and Seekers.  We give you a chance to promote your material in a way which has never been done before.  Account are being created daily, so please be sure to create yours as soon as possible in order to have the username of your choice.
  
  Here are the steps to creating an account:

  • Click on the Sign Up button at the top of the screen: 
  • Put your First and Last name. 
  • Put your Stage Name. ***Optional name that you wish members to see instead of your real name.***
  • Select your username which will be used to log into the site.
  • Select your country and enter your zip code.  ***A valid zip code is needed to registere.***
  • Select your gender.
  • Select your Bubbler Type.  You can choose one of the following: Musician, Model, Dancer, or Seeker.
  • Enter and Confirm your email address and password.  The email you enter can be used to sign-in.
  • Enter the Captcha Code.
  • Check off the Terms of Services and Privacy Policy and then click Sign Up!

  ****Please note that to complete your registration, you will need to click the link that is sent to your email account that you have written.  It is possible that this email goes to junk mail, so please check to your spam mail if you do not receive the email generated by the system.****

  1) You will receive a Verification email sent to the email you provided.

  3) The link will send you to your account settings where you will be able to complete the rest of your account information.

• Promoting Your Profile

  
  
  In order to promote your talent in the most efficient way, you will need to be an active member on TBubble.  Below are a few things you can do in order to have the most successful experience on TBubble:

  • Upload pictures that have a high resolution.
  • Upload videos that are complete and have high definition.
  • Upload music songs which you have created and that truly represent your artistic ways.
  • Invite your friends and fans to see your work by inviting them to TBubble.
  • Try to reach the most fans as possible but always updating your video profile and information so you can connect with them.
  • Share your items on other social media networks such as Facebook and Twitter.
  • Listen to the feedback from other members in order to improve your talent.

• Inviting Friends

  
  
  Inviting all of your friends to come and join TBubble is an easy way to promote yourself and take advantage of the experience you can gain from TBubble.  By selecting the "Invite Friends" tab in the drop down near your status picture, you can easily select all of the accounts that you wish to invite friend from.  
  
  Step 1: Select Invite Friends
  
  Step 2: Select each account that you currently own and invite your friend from these other networks.  Your password will not be made public to TBubble or anyone else.  Once you have completed that information, you will now have the opportunity to enjoy TBubble with your friends.
  
  
  
  

• Profile Picture & Video

  
  
  Your Profile Picture and Video will be the first media that connects to any user on the site when they view you your profile.  Picking a great picture and a great video to introduce yourself to other members is a great way to promote your work and your profile.
  
  In your settings page, you can select the profile tab which is pictured below.  By selecting that tab, it will allow you to upload your profile picture and profile video.  Your profile video is here for you to give your fans and friends a personal introduction to your work without you having to read too much details.
  
  
  

• Updating Your Info & Indutry Profile

  
  
  In order to have the most exposure as possible, you will need to always maintain and update your Info and Industry Profile.  Other members and fans need to know who you are and what you are about, updating these two tabs allows you to keep your favorite fans in the know!
  
  You can access these two tabs by clicking on the left panel or updating your information in settings.
  
  1) Clicking the Info tab
  2) Clicking your industry under My Industries.
  
  Once you have clicked on those tabs, you can click the edit button which will let you complete your information.
  
  
  

• Status Update

  
  
  We have made it easy for you to separate the messages that you send to your friends and to your fans.
  
  The default button on TB Board will always be "All"; but if you click "Friends" before entering your message and pressing enter, then your status update will only be seen by your friends.  Selecting "All" allows for everyone to see your status update in the TB Feed home page panel, in addition to all your friends and fans.  This is a great way to promote your work and your profile.
  
  The picture below shows how you will be able to update your status in that manner.
  
  
  ***Please use your proper judgement when delivering a status to the entire site.
  

• Tips for Uploading Songs, Videos, and Photos

  
  
  Creating a profile which is filled with high quality material is the best way to show that you are serious about your talent, but most importantly, you are serious about your promoting yourself.  You never know who is watching, therefore, it is in your best interest to only upload your best content to keep your profile page fresh.
  
  Upload Songs:  

  • Use unique titles for your songs and albums.
  • Upload a high quaity picture representing your song or album.
  • Make sure to keep your song under the 10mb limit.
  • There are no limits to the number of songs you can upload.
  • Once you are ready to make your song public, change the status to "publish". 

  Upload Videos:

  • High quality videos will give you a great look and also a better connection with your fans.
  • Upload your performances, your talent, your documentaries, and all of the videos that will make others understand who you are as an artist.
  • There are no limits to how many videos you can upload, but please make sure that you keep the videos under 400 mb.
  • Once you are ready to make your video public, change the status to "publish".

  Upload Photos:

  • High quality photos will grab you the attention that you seek. Avoid uploading blurry images.
  • The width and height of the images will vary, but the best images are the ones which are wide enough for the carousel in order to prevent stretching.
  • It is not a bad idea to get professional image.

• How to Upload & Edit Your Songs?

  
  
  To Upload Songs:
  
  Step 1: Click on Media or select Music. You can do that from the top menu on your own profile or by using the menu on the left panel.
           
  
  Step 2: From that media page, click on upload and music.
  
  
  Step 3: On the next window, you will click on add songs. You can choose up to 8 songs at a time.  
  
  
  Step 4: After your songs have been added and processed, you can edit your songs in the following manner:

  1. Add to existing album or  by clicking create a new album.
  2. Once you have selected, you will then proceed to editing the titles of your songs, select the genre, write the description, add the tags, and add a picture to each of your song.  Please note that if you have selected to create a new album, you only have to upload one picture in the album cover location which will be used for all of your songs, but you may choose to upload different pictures if you wish for all your songs to have a different image.
  3. To delete any song, all you have to do is press the delete button.
  4. Once you select publish and save, it will be published to everyone.  Selecting unpublised keeps your items private to you and your friends.

  
  
  ***Please note that publised material will be available for everyone to view.  These items will also be on the featured sections including TB Radio, but our staff reserves the right to remove anything which they feel is harmful to the site or any other individual.
  

• TB Radio

  
  
  Our goal is to create a music experience for our users which will finally get them to hear great music without the repetition of all of the same songs that they hear every time they turn on a radio.  With an unlimited amount of songs to choose from TB Radio, we hope that this will give our users the needed change that they have been waiting to find on the Internet.
  
  Below, you will find all of the things  TB Radio give you:

  • A chance to discover new music from around the world.
  • A filter that allows you to seperate songs by genre and countries.
  • As a musician, a place to promote your music and your artistic skills to individuals who you would have never reached.
  • A distinct, easy to use layout allowing you to continuously hear music for free 24/7.
  • Allows users to put a face to the music.
  • The player has been automatically set to "random" in order for every musician to get air time and for every user to experience new songs and not the same songs.

  Only musicians are allowed to upload music which will be played on TB Radio, however, everyone can listen to TB Radio once they log on to the site.
  
  To add a song or an album to TB Radio, a musician has to publish his/her album or song.  If you keep the status as "Published", every member will be able to hear this song or album, but if you switch to "Unpublished", then only your friends will be able to hear it and the song will not be featured on TB Radio.
  
  
  If for any reason you encounter an error while using TB Radio, please refresh the player.
  
  Only publish music that you believe is ready for the world to listen to!  We want to limit the TB Radio to songs that are complete in order to allow every user to have a great experience!  Please use proper judgment. 
  
  TBubble reserves the right to remove any media which the company feels is not appropriate or fits with the Terms & Conditions of our website.  Copyrighted material which are not your own should not be uploaded to our site.  Any user who is caught uploading material which they do not have a right to will have their account suspended until further notice.

  Our goal is to create a video experience for our users which will allow them to view all types of videos by filtering through our industry, genre, and Country.  Our video player is here to allow you to enjoy your favorite videos and genres without interruption.
  
  Below, you will find all of the things TB Video gives you:

  • A chance to videos from every category created by the genius of our members.
  • A filter that allows you to seperate videos by industry, genre, and countries.
  • As a user, it gives you a place to promote, view, and enjoy the talent of others in a way which will also give you ideas on how to perfect your skills.
  • A distinct, easy to use layout allowing you to continuously play videos for free 24/7.
  • Allows users to connect to their industry through documentaries and experience of others.
  • The player has been automatically set to "random" in order for every user to get air time and for every member to have a variety in the things that they view.

  Every user will be allowed to upload their video content on TB Video, but TBubble reserverves the right to remove any material which they feel is inappropriate.
  
  To add a video to TB Video, a user has to publish his/her video.  If you keep the status as "Published", every member will be able to view this video, but if you switch to "Unpublished", then only your friends will be able to view it and it will not be featured on TB Video.

• Phishing / Hacked Account

  
  
  If you feel that your account has been taken over by someone else, then there is a good chance that your account has been hacked.  
  
  Signs that your account has been hacked:
  * Activity on your account not inserted by you
  * Profile information being changed without you knowing
  * You can no longer sign into your account
  
  Notes
  * Change your password every 3 months
  * Never use the same password on your email and your TBubble account.
  * Keep your password as a secret
  * Never let anyone use your account
  
  
  

• How do I change my Email and Password?

  
  
  * Go to Account Settings 
  * Enter your new email, and verify your that your email is accurate before pressing Save.
  * Enter your new password and verify your new password in teh section below.
  * Once you have made all of your updates, click Save to complete the process.
  
  Notes & Tips
  
  * Your new password should not be similar to your name.
  *Select a password that is different from your current password.
  * Do not use the same password as the email address used to sign up for TBubble.
  * Change your password frequently.
  * Always log out of your profile when using a public computer.
  
  

• Inappropriate Content

  
  
  Our staff will carefully review every profile and account to determine if there exist inappropriate content.  If we find material that violates our Terms of Use, we will take the necessary steps and delete the account/profile.
  
  Below are some violations which will lead to immediate termination of your account:

  * Violence
  * Hate material; that is, language, videos, and images
  * Obscene
  * Cyberbullying
  * Harrassment

  TBubble is a social networking website which offers an exciting way to showcase talent that people want the rest the world to see and communicate around the world.  At the touch of your fingers, you will see that at easy very easy to interact with others without having any barriers, but please understand that your actions online can affect you greatly.  Any information that you share with others has the potential to damage some important opportunities in the future.
  
  Only post material that you are okay with others potentially seeing because it can affect you in the long run; therefore, please think before posting any media or comment!

   The Internet is a community which allows individuals ways to discover, and at the same time, be discovered.  While your children may see this environment as a way to meet new people, they are not aware of the dangers that reside on the Internet.  Please be aware of your children's activity and inform them of what could be considered as too personal or inappropriate.  Teaching them the proper online behaviors is essential and making this environment safe for them.

• Deleting your TBubble Profile/Account

  
  
   If you choose to delete your account, you will need to select "Settings" under the drop down arrow next to your name at the top right of the page.
  
  * You will then select the "Deactivate Account" tab in the Settings menu.
  * Select the reason for deactivating your account and click confirm.

  * Depending on the reason you choose for deactivating your account, all of your materials and data will be completely deleted within 24 hours.

  Controlling your User Settings:
  
  * Click on the drop down at the top right and select settings.
  * On the next page, click on the "User Settings" tab.
     - On this tab, you will be able to control:
                      * Personal Information
                      * Education & Work
                      * Contact Information
                      * Permissions
  
  These items will allow you to control what your friends, fans, and other members can view in regard to your material.
  
  Notes
  * In regard to "pictures, vidoes, and music", these items will be viewable to everyone except if you select "unpublished" when you upload your content.  When you select "unpublished", only your friends will be able to see these specific items.
